How Many Weeks of Severance Per Year of Service?

Last updated: October 2026 · General information, not legal advice

The short answer: the standard rule of thumb is 1–2 weeks of pay per year of service for most salaried employees. Managers commonly land around 2 weeks per year; directors and executives commonly 3–4 or more. Multiply your years of service by your role's rate and you have the range your offer should be compared against.

The rate table

Manager~2 (commonly 2–3)20–30 weeks
Director3–430–40 weeks
VP / Executive3–4+30–40+ weeks

Totals by tenure (individual contributor, 1–2 weeks/year)

2 years2–4 weeks (often with a minimum — see below)
5 years5–10 weeks
8 years8–16 weeks
12 years12–24 weeks
20 years20–40 weeks

Compare the rate, not just the total: 12 weeks sounds generous until you divide by 15 years of service and get 0.8 weeks per year — below the standard band. Conversely, 8 weeks for a 3-year employee (2.7 per year) is a strong offer even though the total looks small. Our free checker does this division for you.

The minimum floor

Formulas break down at short tenures — 1 week of severance for a 1-year employee follows the math and still feels wrong. Many employers solve this with a minimum package, commonly around 4 weeks, regardless of the per-year calculation. If your tenure is under about 4 years and the offer is 1–2 weeks total, the floor convention is your talking point.

Why 2026 packages are smaller than you remember

Overall median packages are commonly reported around 10–14 weeks in 2026, down from roughly 19 weeks in 2023. Employers trimmed formulas as layoffs became routine — particularly in tech, which announced 165,925 job cuts in the first nine months of 2026 (Challenger, Gray & Christmas), with AI cited as a factor in 120,136 of them. The per-year rates above are the current ones: if a colleague's 2022 package is your reference point, adjust it down before you conclude yours is insulting — or up, if your rate is below even the trimmed standard.

What the weeks don't include

Is there a legal minimum number of weeks?

No. In the U.S., no general law entitles a laid-off employee to any severance at all. The exceptions are contractual: an employment agreement, a collective bargaining agreement, or a company policy that promises it. The numbers on this page are market norms — what employers commonly pay — which is what "fair" is measured against when you negotiate.
